This action, commenced on August 19, 1953, was brought to recover damages sustained on account of the death of Keith McNamer, resulting from an automobile collision which occurred on November 5, 1951, at about 8:30 P.M. McNamer was driving his automobile westerly on highway 33 in Juneau County. The defendant Dempsey was driving a truck owned by his employer, the defendant Wonewoc Rendering Works, easterly on the highway. A head-on collision occurred. The only surviving eye witness to the accident was Dempsey. McNamer was killed immediately.
